Our actions
Internet Auctions: We monitor the big sites, eBay and others, daily and take down fake sellers when we find them. We have removed thousands of auctions of fakes.
Websites: We are working closely with police forces but also Google, Bing, Yahoo, MSN and others to identify the sellers of fake Louboutin shoes. The program has taken down hundreds of sites, adverts, both sponsored and unsponsored links that take you to sellers of fake goods. We use copyright, trademark, design rights or other claims to achieve almost unprecedented assistance from the search engines to take down sites.
Web Hosting Service Providers: Our program uses our IP rights, especially copyright laws, to force web hosts to close down sites they are hosting which we identify as selling fake products and violating our IP rights. We have compliance in large measure in many countries, stretching from the United States, to Panama, Korea, Japan and sometimes China.
UDRP Procedure: When we find a site that keeps coming back, we file actions seeking a formal cancellation of the site's domain name or other similar action with the various bodies that by international agreement have the authority to literally wipe a site's web address off the books, or force a registrar to do so.
Other Internet Issues: The bad guys are clever. Lately they are using blogs that appear to write articles but really are just another way to lead you to fake sellers' sites. We take them down. We monitor all the social sites, such as Facebook, Twitter, etc. where the counterfeit dealers are found as well. When we find, we take down.
Customs: Our trademarks are registered with Customs services throughout the World. Those services are supported through constant training and dialogue with our counsel and ourselves.
Investigations: We maintain a large number of field investigators throughout the World who follow up on all information we receive regarding those who sell fake Christian Louboutin products. The investigators turn information over to our counsels who, under our direction act on it.
Raids: Comprehensive program implemented. Our field investigators are looking for factories and wholesale stores. When they find one, the appropriate authorities are informed and raids are done. All the fake products are seized and destroyed.
Civil Actions: Depending on the size of the wrongdoer we use all remedies available, everything from a cease and desist letter, a search and seize order, an order freezing the counterfeiter’s assets, a confrontation, to a judgment against the counterfeiter, and wherever possible we take fake products, records and money damages.
Criminal Actions: If the party appears to be one that warrants criminal action, we interface directly with the law enforcement authorities in the country to seek and encourage criminal prosecution of those who sell fakes.
Other: This is not a comprehensive list. Bottom line: whatever works to get counterfeiters to stop, we use. We measure our resources to be sure. Not everyone gets the same response but we move against everything. This is what we mean by "Zero Tolerance." No one should believe because they are relatively small they will not be found or not moved against. Not so. We will cooperate with Fiscal, Tax, Postal, Shipping, Law Enforcement, Customs or simply do it ourselves, but we will take them down where possible.
